Summary Criminal Offences

If you have been charged with a summary criminal offence under the Criminal Code of Canada, or if you have been charged with a hybrid offence and the Crown Attorney has elected to proceed with the charge(s) summarily, Deb Howitt is here to represent you in court!

Here are a few examples of summary offences and/or hybrid offences that can proceed by summary conviction: 

  • Mischief under $5,000, s. 430(4) CC

  • Causing a disturbance, s. 175(1) CC

  • Uttering threats - Damage property, s. 264.1(1)(b) CC

  • Theft under $5,000, s. 334 CC

  • Assault, s. 266 CC or Assault with a weapon, s. 267(a) CC

  • Unlawfully in dwelling house, s. 349(1) CC

  • Failure to comply with appearance notice or promise to appear, s. CC 145(5)(b)

We also cover offences under federal statutes other than the Criminal Code of Canada, such as the Cannabis Act or the Controlled Drugs and Substances Act, as long as it is a summary offence, or a hybrid offence that has been elected to proceed by summary conviction
